1) UNDERTAKINGS
The property is leased for temporary location purposes that the tenant declares not to be linked with neither work nor study,
the future tenant wishing to guarantee the availability of a property exclusively for tourism purposes, according to Article 1,
Paragraph 2 Letter c) of Italian Law n. 431/98. The current leasing contract is not therefore subject to the Fair Rent Act
Article 26, Letter a) of Italian Law n. 392/1978
2) CONDITIONS OF STAY
The presence, even occasional, in the property, of a number of people above the agreed number will be breach of contract according
to Article 1456 of the Italian Civil Code and it will oblige the tenant to pay the Agency an amount, that it will collect
in the name and on behalf of the owner, which is equivalent to the amount of the agreed rent as penalty according to Article 1382
of the Italian Civil Code. Children are considered as adults for this purpose. Domestic animals can be brought and kept in the property
only if authorised by the Agency and according to the regulations of each property. All the guests are obliged to respect the Rules
of each property. The Agency will not be held responsible for eventual complaints in the case in which the tenant,
having booked by telephone, is not satisfied with the accommodation. It is forbidden to sub-locate and/or substitute and/or alternate
occupants of the apartment with other people.
Minors or under 18 can stay without a parent only if accompanied by an adult with a proxy from their parents or legal guardian and a copy of the document.
The apartment is not available for parties, stag bachelor/ hen parties and various celebrations.
3) AGENCY RESPONSABILITY
The Agency only acts as an intermediary between the client and the owner of the apartment. Therefore the
Agency shall be discharged from all liability.
Guests are advised that the agency does not respond to requests for compensation for damage and/or malfunctions in
the condominium parts such as:
malfunction / closure of elevators and gates, swimming pools
damage / theft in the parking spaces assigned to the rented apartment, sudden interruption of electricity.
4) BOOKING
Booking is only confirmed when the deposit is received.
5) PAYMENT
30% of the rent must be paid as deposit directly to the Agency. The booking deposit according to Article 1385 of the Italian Civil Code will be
detracted from the rent on arrival and access will be given to the apartment. The keys of the apartment will be provided only after complete payment
of the rent and eventual additional expenses.
6) ARRIVAL
Arrival must take place on the agreed day, between 4pm and 7.30pm.
7) SECURITY DEPOSIT
The tenant must take upmost care of the apartment and of the domestic appliances (crockery, fridge, mattresses etc.) Eventual breakage or damage
of objects must be refunded. As a security the tenant will pay on possession of the keys to the Agency a deposit which does not give right to
interest equal to €100,00/€200,00 which will be given back at the end of the rental period, after the apartment has been checked. For eventual
damages the necessary amount for repair will be detracted from the deposit.
Losing the keys of the apartment / safe will have a cost that will be deducted from the deposit/caution paid
8) DEPARTURE
The apartment must be vacated by 10am of the agreed day. The departure must take place during business hours to allow the staff to inspect the
apartment and its cleanliness. The apartment must be left tidy, free from rubbish, with insides of shelves cleaned, floors swept, dishes washed and
the fridge defrosted and empty.
9) CANCELLATION
In case of booking cancellation for the stay for any reason the deposit will not be returned. In the case the client decides to leave earlier than
the agreed day in the contract for departure, the Agency will not give back the rent and expenses already paid.
10) APPARTMENT FURNISHINGS
All our apartments are fully furnished and provided with crockery in relation to the number of beds available. It is the responsibility of the
Agency to call the gas container supplier for refill, compatible with their business hours. The tenant must take responsibility in informing the
Agency of eventual defects of the property and furniture within 24 hours after receiving the keys. In the case of the Agency not being informed,
the tenant may be considered liable for such defects.
The agency is not responsible for the sudden interruption of electricity / water / gas
The BBQ is allowed only if authorized by the agency and in consideration of the regulations.
It is forbidden to move the furniture of the apartment (tables-beds-sofas etc ...)
11) SWIMMING POOL
Opening hours of the pool are decided by the Housing Committee. Generally the opening day corresponds to the first week of the month of June.
The agency is not responsible for the malfunction or closure for sanitation of the swimming pools.
12) BEACH
The beach service (an umbrella and two reclining chairs for each apartment) is subject to weather conditions. The position and facilities are
decided by the Beach Consortium based on spaces available on the beach.
13) PRIVACY
According to and as result of Italian Law n. 196/2003 and its subsequent changes on “Protection and processing of personal data” we inform
that personal data provided in the booking module will be treated by the Agency according to such Law.
We inform you that the processing of the private data provided here will take place in compliance with the provisions of
law 196/2003 on the protection of privacy and EU regulation 679/2016 - General Data Protection Regulation ("RGPD") and subsequent amendments.
The parties authorize the sending of informative / commercial e-mail
14) DISPUTE
Every dispute that should eventually arise in relation to the present writing, will be dealt with in a friendly manne
